People v. Johnson 889 N.W.2d 513 (2016), appeal denied, 500 Mich. 951, 891 N.W.2d 231 (2017) 315 Mich. App. 163, 2016 WL 1576933 (Mich. App. Apr. 19, 2016) This case involves challenges to the courtroom procedure of allowing a witness to be accompanied on the witness stand by a support animal. Defendant Johnson appealed his convictions of criminal sexual assault after he was convicted of assaulting his six-year-old niece. During Defendant's trial, a black Labrador retriever was permitted, to accompany the six-year-old victim to the witness stand. On appeal, the Defendant first argued that his trial counsel was ineffective for failing to object to the use of a support animal because MCL 600.2163a(4) only allows a support person. The Court of Appeals of Michigan stated that the trial court had the inherent authority to utilize support animals. Secondly, the Defendant argued that trial counsel should have objected to the notice of a support person on the basis that allowing the witnesses to testify accompanied by the support animal violated his constitutional right to due process. The Court of Appeals stated that there is no indication that the support dog used was visible to the jury, or that he barked, growled, or otherwise interrupted the proceedings. Therefore, the objection was meritless. Next, the Defendant argued that his counsel was ineffective for failing to request various procedural protections if the support animal was used. The Court of Appeals stated that the use of a support dog did not implicate the Confrontation Clause; the presence of the dog did not affect the witnesses' competency to testify or affect the oath given to the witnesses; the witnesses were still subject to cross-examination; and the trier of fact was still afforded the unfettered opportunity to observe the witnesses' demeanor. Finally, the Defendant argued that a limiting instruction should have been provided to the jury when the support animal was utilized and this rendered his counsel ineffective. The Court of Appeals stated, that there are no Michigan jury instructions addressing the use of a support animal. Counsel was then not ineffective in failing to ask for an instruction that does not yet exist in Michigan. The Court of Appeals affirmed the defendant's convictions and sentence and remanded. Case
Peklun v. Tierra Del Mar Condominium Association, Inc. Not Reported in F.Supp.3d, 2015 WL 8029840 (S.D. Fla., 2015) On cross-motions, Defendant Tierra Del Mar Condominium Association, Inc.'s (“TDM") and Plaintiffs, (Personal Representatives of the Estate of Sergey Peklun) seek Summary Judgment. Plaintiffs assert that denial of Sergey Peklun's request for a reasonable accommodation for his dog Julia "resulted in Peklun's increasingly despondent attitude, ultimately culminating in his decision to end his life." As such, plaintiffs’ claim Defendants are liable under theories of intentional infliction of emotional distress and violations of the Florida and Federal Fair Housing Acts. This conflict over Julia first emerged in 2011 and lasted until Peklun's death in 2015. In 2011, Peklun first acquired Julia the dog, who he claimed was being trained as a cardiac service dog. While the training as a service dog was never substantiated, the Board did approve the dog as an emotional support animal for Peklun in 2011. The composition of the Board changed in coming years and the issue arose after another tenant, Frank Speciale, demanded the dog's removal due to stated allergies. TDM warned Peklun if he did not remove Julia within the period provided, it would initiate arbitration against him in accord. Julia was never removed and, on July 16, 2013, TDM commenced arbitration against Peklun with the Florida Division of Condominiums, Timeshares, and Mobile Homes. Speciale also moved for an injunction barring Peklun from keeping Julia on the premises, which was granted on March 11, 2014. During this time, the Palm Beach County Board of County Commissioners Office of Equal Opportunity organized an extensive investigation into TDM's purported discrimination and found "reasonable grounds to believe that [TDM] discriminated against [Peklun] on the basis of his disability.” Following this, on August 11, 2014, TDM approved Peklun's request for a reasonable accommodation as an emotional support animal. Despite this, Speciale continued to seek Julia's eviction, filing a motion in state court, seeking contempt and sanctions. Plaintiffs contended that this behavior reflected "a campaign of harassment." As to TDM instant motion for summary judgment, it claims the decision was reasonable because Peklun failed to provide TDM with the requested information necessary to verify his disability and that Julia was not a trained service animal. Also, TDM asserts Peklun was not a “qualified individual” under the FHA. The District Court found that while Peklun's various cardiac and organ problems did not constitute a "handicap" under the FHA, the submissions of Peklun's treating physicians are sufficient to establish that Peklun's sleep apnea interfered with a major life activity. As a result, there was sufficient evidence that Peklun was handicapped within the meaning of the FHA. Further, the absence of any certification or training did not permit TDM to immediately deny the request for Peklun's assistance animal. In fact, the court observed that Peklun was previously granted an accommodation for Julia on the basis that she was an “emotional support animal” in 2011; that knowledge of the 2011 accommodation was imputed to TDM's current board. The court did note that Section 3604(9) states there is no obligation to honor a request that would constitute a direct threat to the health or safety of other tenants. However, the court noted that determining this threat is a question of fact, not a question of law. The issue of Speciale's allergies "is contentious and the Court declines to grant judgment based on a hotly debated factual dispute." As a result, the cross motions for summary judgment by each party were denied. Case
Overlook Mut. Homes, Inc. v. Spencer 666 F. Supp. 2d 850 (S.D. Ohio 2009) The barking of Scooby the dog, caught the attention of nearby neighbors, and the Plaintiff, Overlook Mutual Housing Corporation. Overlook established a no-pet rule for its residents with an exception for service animals. Scooby's owners (the Spencers) received a letter warning them to remove the dog from their home. In response, the Spencers obtained a letter which requested that Overlook make a reasonable accommodation for their daughter Lynsey, who needed a support dog to facilitate in her psychological treatment. Overlook did not grant the Spencer's request for accommodation and filed a Complaint against them. The Spencers then filed a counter claim and Overlook then moved for summary judgment. The court stated that pet policies have to comply with the Federal Fair Housing Act (FHA). Based on the intent of the FHA to provide reasonable accommodation rather than public access like the ADA, HUD and the DOJ's recently revised regulations on the need for emotional support animals in HUD-assisted housing, and previous actions brought against housing providers that denied emotional support animals, this court concluded that emotional support animals can qualify as reasonable accommodations under the FHA. Further, the court held that they do not need to be individually trained like service animals. Overlook's motion for summary judgment was denied. Case
Ohio v. George 2014-Ohio-5781 (App. Ct, 2014) Clayton George was convicted of raping two children of his girlfriend, age six and eight at the time of the crime. Among assignments of error on appeal was that the trial court had abused its discretion in allowing Avery, a facility dog, to accompany the two children during their testimony without a showing of necessity. On appeal, the defense argued that (1) unlike the facility dogs in Tohom, Spence, and Dye, Avery was “recognizable on the record while he was in court,” (2) the prosecution failed to show necessity for having Avery at trial, and (3) the standards set in Tohom, Spence, and Dye should have applied to determine whether Avery was permitted at trial. The appellate court noted that the defense had not objected to the presence of the dog during the trial nor had he made these three points at trial, meaning that the appellate court did not need to consider them for the first time on appeal under Ohio appellate law. The assignments of error were all overruled and the judgement of the trial court was affirmed. Case
Nason v. Stone Hill Realty Association 1996 WL 1186942 (Mass. 1996) A tenant with multiple sclerosis took in her mother's cat when her mother became ill. The housing authority had a no pets policy and requested that the tenant remove the pet from the premises. The tenant in turn offered a letter from her physician stating that "there would be serious negative consequences for her health if she was compelled to remove the cat." The court held that the tenant did not meet her burden of proving a nexus between the cat and her multiple sclerosis, reasoning that the physician's note does not state that the cat is necessary to alleviate her symptoms and that a more reasonable accommodation may be available. Matter of S. A. B. 531 P.3d 718, review denied sub nom. Dep't of Hum. Servs. v. T. B., 371 Or. 476, 537 P.3d 939 (2023) 326 Or.App. 192 (Or.App., 2023) In this Ohio juvenile dependency case, a father appeals a juvenile court judgment ordering him to transfer the his dog to his child, claiming that the court lacked the authority to transfer possession of the dog. He also claims the dog is his personal property and not the child's. The child, who does not live with the father, suffers from panic attacks and has difficulty sleeping at night. The child's therapist testified that the child's mental health symptoms are exacerbated by "missing and worrying about the dog." The therapist testified that, because of the bond that child shares with the dog, the child's emotional support dog should be this particular dog. In contrast, the father claims the dog is legally his and provides a household benefit for him by keeping raccoons away from his chickens and deterring thieves from entering the property. The lower court found that the child shares a bond with the dog and having the dog as an emotional support animal would benefit the child. On appeal, the father argues that an emotional support animal does not fall within the statutory definition for "counseling" and, thus, the court's order was tantamount to giving away his property. In looking at the statute, the court noted that "counseling" is undefined and so looking at the plain and ordinary meaning is appropriate. As a result, the court found that the dictionary definition read with the policy goals of the chapter on jurisdiction of the juvenile court allowed the court to conclude that the term "counseling" includes the use of emotional support animals. The evidence in this case also shows that this particular dog is necessary as ". . . this particular dog is not just a pet, but rather is an emotional support animal for child, as evidenced by child's strong emotional bond with this particular dog and various testimony demonstrating that this particular dog will contribute to child's well-being by providing child with emotional stability and security." As to the property issue raised by the father, the court observed that courts routinely order parents to provide support for their children and this transfer of property did not abuse the court's discretion. Manzke v. Jefferson County Slip Copy, 2018 WL 5095678 (W.D. Wis. Aug. 21, 2018) 58 NDLR P 49 (W.D. Wis. Aug. 21, 2018) Joshua Pernat and Sara Manzke owned property that had four miniature goats and two geese on it. Sara (plaintiff) applied for a zoning variance and a conditional use permit to accommodate her emotional support animals. Jefferson County and the Town of Ixonia denied her applications. Sara then brought forth claims under the Fair Housing Amendments Act and Wisconsin’s Open Housing Act that she was discriminated against by Jefferson County and the Town of Ixonia. Joshua and Sara also sought a notice of removal of a small claims action brought forth by Jefferson County seeking monetary sanctions for the alleged violations of the zoning variance. Jefferson County argued that the plaintiff’s federal reasonable accommodation claim was not ripe because the County never made a final decision with respect to Sara’s applications for a variance and conditional use permit. When the Town of Ixonia voted to recommend that Jefferson County deny the plaintiff’s variance application, the plaintiff withdrew her applications from consideration. Sara argued that the town’s denial “foretold a denial by the County,” and any further appeal to the County would have been fruitless. The Court did not agree. The County had no obligation to follow the town’s recommendation. The Court dismissed plaintiff’s Fair Housing Amendments Act claim for lack of subject matter jurisdiction and accordingly dismissed plaintiff’s state law claim without prejudice. Since Sara was unable to state a federal claim, the Court also held that Sara and Joshua could not remove the small claim by Jefferson County to federal court. Case
Majors v. Housing Authority of the County of DeKalb Georgia 652 F.2d 454 (5th Cir. 1981)

Tenant had a history of mental illness and kept a dog in her apartment despite a "no pets" policy. The housing authority refused to waive the "no pets" policy and brought an eviction proceeding. Tenant filed a complaint in federal district court alleging violation of Section 504 of the Rehabilitation Act for failure to waive the "no pets" policy as a reasonable accommodation for her disability. The district court granted the housing authority's motion for summary judgment and the tenant appealed. The court of appeals held that the housing authority deprived the tenant of the benefits of the housing program by enforcing the no pets rule, reasoning that waiving the no pets rule would allow the tenant to fully enjoy the benefits of the program and would place no undue burdens on the housing authority.

Levine v. National Railroad Passenger Corporation 80 F. Supp. 3d 29 (D.D.C. 2015) 2015 WL 674073 (D.D.C., 2015) This action arose from plaintiff’s experience of bringing her service dog on Amtrak trains. Plaintiff brought claims on her own behalf and on behalf of a putative class of other disabled passengers against Amtrak pursuant to the Americans with Disabilities Act, the Rehabilitation Act of 1973, and the District of Columbia Human Rights Act. Each claim related to Amtrak′s alleged practice of storing luggage in its train's “mobility aid” seating areas. Amtrak argued, amongst other things, that plaintiff lacked Article III Constitutional Standing because she had not suffered an injury in fact. The district court agreed and granted Amtrak′s motion to dismiss. The case was dismissed in its entirety. Case
Leigh v. State 58 So. 3d 396 (Fla. Dist. Ct. App. 2011) 36 Fla. L. Weekly D778 (Fla. Dist. Ct. App. 2011) Philip Leigh (Defendant) appeals from an order summarily denying his motion for postconviction relief. Following a jury trial, Defendant was found guilty of trafficking in cocaine and conspiracy to traffic. Defendant claimed his trial counsel was ineffective for allowing him to appear in a leg restraint and for failing to object to the presence of a dog. Apparently, the dog became disruptive on more than one occasion and was visible to the judge and jury. The Florida appellate court reversed and remanded, with a provision that the trial court could attach portions of the record that would refute the possibility that defense counsel’s failure to object to the dog’s presence indicated ineffective assistance of counsel. Since there was apparently no evidence of the dog’s presence in the record at all, the trial court was presumably obligated to conduct an evidentiary hearing on the matter. Case
