BROWN v. TOWN OF SOUTHBURY 53 Conn. 212, 1 A. 819 (1885)

This Connecticut decision in 1885 held consequential losses as a result of the harm to an animal (a horse) to be a proper element of damages in addition to the fair market value of the animal. Specifically, the court applied fair market value, but disallowed consequential damages for lost profits where plaintiff failed to show an effort to mitigate such damages.

Panattieri v. City of New York 53 Misc. 3d 865, 37 N.Y.S.3d 431 (N.Y. Sup. Ct. 2016)

Ceasar, a mixed breed dog, was seized by police after he killed another dog and injured the other dogs’ owner. Petitioners, Kristina & Douglas Panattieri, owned Ceasar and demanded his return to their custody. They also challenged the determination by Respondent, Department of Health & Mental Hygiene (DOHMH), to execute Ceasar pursuant to the New York City Health Code (24 RCNY) § 161.07. The Petitioners argued that Ceasar’s execution would be unconstitutional under the City Code because it was preempted by the state statute, Agriculture & Markets Law § 123.The Supreme Court, New York County, denied their petition and held that the New York City Health Code was not preempted by the state statute. The Court reasoned that the Agriculture and Markets Law § 107(5), which governed licensing, identification, and control of dogs, expressly allowed municipalities to enact their own Codes governing dangerous dogs. However the City Codes were to incorporate standards that were as or more protective of public health and safety than those set forth in the state statute. The New York City Code met the requirement and was therefore not preempted by state law.

Commonwealth v. Szewczyk 53 N.E.3d 1286 (Mass.App.Ct.,2016) In this Massachusetts case, defendant was charged with animal cruelty after he shot a dog that had wandered onto his property with a pellet gun. The pellet was lodged in the dog’s leg and caused significant pain and discomfort to the dog. Following conviction, defendant appealed the District Court’s ruling arguing that the judge erred in denying three of his eleven requests for rulings of law.Specifically, defendant's principal argument was that he had a lawful purpose in shooting (to scare the dog off his property), his intent was justified (to insure his wife's safety on the property), and the pain inflicted by defendant shooting the dog does not fit the statutory meaning of "cruel." At the close of evidence, defendant submitted a written request for ruling under Mass. R.Crim. P.26 setting out these issues. The court held that the District Court judge correctly denied the three requests because they were clearly outside the scope of rule 26 because they called upon the judge as a fact finder to weigh the evidence presented at trial. Next, the court reviewed the facts of the case to determine whether or not a rational trier of fact could have found the elements of the crime beyond a reasonable doubt. Ultimately, the court held that a rational trier of fact would have been able to find that defendant did commit animal cruelty by shooting the dog. The court focused on the fact that the defendant could have used other means to ensure that the dog did not enter the property again without causing pain and suffering to the dog by shooting the dog in the leg. The judgment was affirmed.
Hoesch v. Broward County 53 So.3d 1177 (Fla.App. 4 Dist., 2011)

A Broward County, Florida ordinance defines a dangerous dog as “any dog that . . . [h]as killed or caused the death of a domestic animal in one incident.” Plaintiff Brian Hoesch’s dog escaped from Hoesch’s backyard and attacked and killed a neighbor’s cat. Prior to this incident, the dog had never been declared “dangerous” by any governmental authority. Hoesch requested a hearing after Broward’s animal control division notified Hoesch of its intent to destroy his dog. After a judgment in favor of Broward County, Hoesch contends that both county ordinances conflict with state law, section 767.11(1)(b), which defines a “dangerous dog” as any dog that “[h]as more than once severely injured or killed a domestic animal . . . .” The District Court of Appeal of Florida, Fourth District, concluded “that Broward County ordinance sections 4-2(k)(2) and 4-12(j)(2) are null and void insofar as they conflict with state law.” 

McConnell v. Oklahoma Gas & Elec. Co. 530 P.2d 127 (Okl. 1974)

In this Oklahoma case, defendant gas company left the plaintiff's yard gate open through which the plaintiff's dog escaped and was then hit by a car. In finding that the gate being left open was the proximate cause of the injury, the court held that the allegations in plaintiffs' amended petition, stated a cause of action and that the trial court erred in sustaining defendant's general demurrer to the petition.

Coos County Board of County Com'rs v. Kempthorne 531 F.3d 792 (9th Cir., 2008) The issue here is whether FWS has an enforceable duty promptly to withdraw a threatened species from the protections of the ESA after a five-year agency review mandated by the Act found that the species does not fit into a protected population category. The species at issue here are murrelets-small, dove-sized birds that feed primarily on sea life and nest in coastal mature and old-growth forests. This Court concluded that Coos County has not alleged a failure to perform a nondiscretionary act or duty imposed by the ESA, whether premised on the petition process deadlines or on the agency's more general duty to act on its own determinations.
Matter of S. A. B. 531 P.3d 718, review denied sub nom. Dep't of Hum. Servs. v. T. B., 371 Or. 476, 537 P.3d 939 (2023) In this Ohio juvenile dependency case, a father appeals a juvenile court judgment ordering him to transfer the his dog to his child, claiming that the court lacked the authority to transfer possession of the dog. He also claims the dog is his personal property and not the child's. The child, who does not live with the father, suffers from panic attacks and has difficulty sleeping at night. The child's therapist testified that the child's mental health symptoms are exacerbated by "missing and worrying about the dog." The therapist testified that, because of the bond that child shares with the dog, the child's emotional support dog should be this particular dog. In contrast, the father claims the dog is legally his and provides a household benefit for him by keeping raccoons away from his chickens and deterring thieves from entering the property. The lower court found that the child shares a bond with the dog and having the dog as an emotional support animal would benefit the child. On appeal, the father argues that an emotional support animal does not fall within the statutory definition for "counseling" and, thus, the court's order was tantamount to giving away his property. In looking at the statute, the court noted that "counseling" is undefined and so looking at the plain and ordinary meaning is appropriate. As a result, the court found that the dictionary definition read with the policy goals of the chapter on jurisdiction of the juvenile court allowed the court to conclude that the term "counseling" includes the use of emotional support animals. The evidence in this case also shows that this particular dog is necessary as ". . . this particular dog is not just a pet, but rather is an emotional support animal for child, as evidenced by child's strong emotional bond with this particular dog and various testimony demonstrating that this particular dog will contribute to child's well-being by providing child with emotional stability and security." As to the property issue raised by the father, the court observed that courts routinely order parents to provide support for their children and this transfer of property did not abuse the court's discretion. Affirmed.
Cardenas v. Swanson 531 P.3d 917 (Wyo., 2023) The Cardenas family (Appellants) owned three St. Bernard dogs. Appellants lived on a home adjacent to large tracts of state land, and would allow the dogs to roam the land unleashed, but the dogs would return each night. One afternoon, the dogs were let outside to run, but one dog did not return. Appellants found the dog caught in a snare, where it died from a broken neck. Appellants attempted to free the dog from the snare, and one of the Cardenas children was injured in the process. While appellants were attempting to free their dog from the snare, the other two dogs were also caught in snares, and died from their injuries. Appellants filed suit against the trapper who set the snares (Appellee), asserting claims of negligence, willful and wanton misconduct, violation of statutes, infliction of emotional distress, and civil rights violations. Appellee filed a motion for summary judgment, which the trial court granted and denied in part, finding that appellee’s conduct was not willful and wanton and that appellants could not recover emotional damages for the loss of the dogs. On appeal, the court considered: (1) whether the members of the Cardenas family can recover damages for emotional injuries for the loss of their dogs, and (2) whether this court should allow the recovery of emotional distress damages for the loss of a pet. The court held that (1) emotional injuries for the loss of property are not recoverable, under this court’s precedent emotional damages are only recoverable for certain limited situations. Dogs are considered personal property under state law, and damage to personal property is not one of the situations in which emotional damages are recoverable. Next, the court held that (2) it would not create a precedent to allow people to recover emotional distress damages when animate personal property is harmed, as that change would be best suited for the legislature to make. The court affirmed the judgment of the trial court and dismissed the case.
Whittier Terrace Associates v. Hampshire 532 N.E.2d 712 (Mass. 1989)

Defendant was a person with a psychiatric disability and living in public housing. Defendant claimed to have an emotional and psychological dependence on her cat. The court held that the housing authority discriminated against defendant under Section 504 of the Rehabilitation Act for failure to waive the no pets policy as a reasonable accommodation for the mental disability. The court noted that there must be a narrow exception "to the rigid application of a no-pet rule, involving no untoward collateral consequences," because the handicapped person could fully receive the benefits of the program if provided the accommodation.

Justice v. State 532 S.W.3d 862 (Tex. App. 2017) In this Texas appeal, defendant Brent Justice contends that his conviction for a single count of cruelty to a nonlivestock animal was based on insufficient evidence. The incident stemmed from defendant's filming of his co-defendant, Ashley Richards, torturing and killing of a newly-weaned puppy. Justice and Richards ran an escort business named "Bad Gurls Entertainment" that focused on the production and distribution of animal "crush" videos (fetish videos involving the stomping, torturing, and killing of various kinds of animals in a prolonged manner). The evidence that supported the conviction involved the confessions of both perpetrators and the video of the puppy being tortured and ultimately killed. On appeal, defendant argues that he cannot be found guilty since was not the principal involved in the offense. This court was unconvinced, finding that the evidence was sufficient to support a state jail felony since "[t]here is no shortage of evidence that appellant aided Richards in her cruelty," including handing Richards the knife and filming the killing. The one issue in defendant's "hybrid" pro se and represented brief on appeal that the court granted was related to a finding that defendant used a "deadly weapon." After the filing of initial briefs, the Court of Criminal Appeals in Prichard v. State, No. PD-0712-16, --- S.W.3d ---, 2017 WL 2791524 (Tex. Crim. App. June 28, 2017), held that “a deadly weapon finding is disallowed when the recipient or victim is nonhuman.” Thus, in the case at hand, the court deleted the deadly weapon finding since it was directed at the puppy rather than a human. The case was remanded for a new hearing on punishment only since the conviction was affirmed for a state jail felony.
U.S. v. Stevens 533 F.3d 218, 2008 WL 2779529 (C.A.3 (Pa.),2008) Note that certiorari was granted in 2009 by --- S.Ct. ----, 2009 WL 1034613 (U.S. Apr 20, 2009). In this case, the Third Circuit held that 18 U.S.C. § 48, the federal law that criminalizes depictions of animal cruelty, is an unconstitutional infringement on free speech rights guaranteed by the First Amendment. The defendant in this case was convicted after investigators arranged to buy three dogfighting videos from defendant in sting operation.  Because the statute addresses a content-based regulation on speech, the court considered whether the statute survived a strict scrutiny test. The majority was unwilling to extend the rationale of Ferber outside of child pornography without direction from the Supreme Court.  The majority found that the conduct at issue in § 48 does not give rise to a sufficient compelling interest.
Posnien v. Rogers 533 P.2d 120 (Utah 1975)

The plaintiff sought to recover damages for the defendant's negligence in the diagnosis and the treatment of plaintiff's brood mare, which resulted in the mare's infertility. Plaintiff was required to show that Dr. Rogers did not exercise the care and diligence as is ordinarily exercised by skilled veterinarians doing the same type of work in the community, and that the failure to exercise the required skill and care was the cause of the injury. Experts testified at trial that the care exercised by Dr. Rogers met the standard of care of veterinarians practicing in the area, and had they been treating the mare, the treatment would not have differed substantially from that of Dr. Rogers.  The Supreme Court held that the record is clear that the plaintiff failed to sustain his burden that the care of Dr. Rogers did not meet the standard of care of other practitioners practicing in the community.

Animal Legal Def. Fund v. Olympic Game Farm, Inc. 533 P.3d 1170 (Wash. 2023) This case is brought by the Animal Legal Defense Fund (Plaintiff) against a private zoo based in Washington state, known as Olympic Game Farm, Inc (Defendant). Plaintiff argues that defendant has violated Washington’s wildlife laws, animal cruelty laws, and the Washington and federal Endangered Species Acts. Plaintiff also argues that defendant has created a public nuisance, which is a nuisance that “affects equally the rights of an entire community or neighborhood, although the extent of that damage may be unequal.” Generally, conduct the Washington legislature has named a public nuisance relating to animals are those which have an adverse impact on public land, such as improper discharge of pollution or animal carcasses, or other interferences with public enjoyment of land and public safety. None of these nuisances reference any animal cruelty laws and no animal protection statues name a nuisance as a violation of those laws. However, plaintiff argued that they have demonstrated that defendant is in violation of animal cruelty and wildlife laws, and asked the court to name the violation of these laws as a public nuisance per se. The court found that previous cases regarding public nuisance claims limit those claims to instances of property infringement or threats to public health and safety. Accordingly, the court held that defendant’s alleged violation of the wildlife, animal cruelty, and endangered species laws, did not constitute a public nuisance.
I.B. Sirmans v. State 534 S.E.2d 862(Ga.App.,2000)

Defendant was convicted of four counts of animal cruelty and one count of simple assault. The portion of the sentence depriving defendant of animals which the State failed to demonstrate were abused vacated and case remanded; judgment affirmed in all other respects because the motion to suppress was properly denied, and defendant was not prejudiced by the trial court's refusal to sever the trial.

State of Florida v. Peters 534 So.2d 760 (Fla.App. 3 Dist. 1988). This is an appeal from an order of the county court invalidating a City of North Miami ordinance regulating the ownership of pit bull dogs.  The ordinance in question, City of North Miami Ordinance No. 422.5, regulates the ownership of pit bulls by requiring their owners to carry insurance or furnish other evidence of financial responsibility, register their pit bulls with the City, and confine the dogs indoors or in a locked pen.  The court dismissed defendants claims that the ordinance violates equal protection and due process, and that the ordinance's definition of a pit bull is on its face unconstitutionally vague.
Boling v. Parrett 536 P.2d 1272 (Or. 1975)

This is an appeal from an action claiming conversion when police officers took animals into protective custody.  Where police officers acted in good faith and upon probable cause when a citation was issued to an animal owner for cruelty to animals by neglect, then took the animals into protective custody and transported them to an animal shelter, there was no conversion.

Caswell v. People 536 P.3d 323 (Colo., 2023) This case concerns several charges of animal cruelty against petitioner Caswell. A welfare check was conducted by a deputy at the Lincoln County Sheriff’s office in response to a report on Ms. Caswell. After two welfare checks were conducted, the deputies executed a search warrant at the Caswell residence, resulting in the seizure of sixty animals. These animals lacked sufficient food or water, were kept in enclosed spaces filled with feces and urine, and many of the animals were underweight or had untreated medical problems. Respondent, the People of the State of Colorado, charged Ms. Caswell with forty-three class six counts of cruelty to animals, which were charged as felonies because Ms. Caswell had prior convictions of misdemeanor animal cruelty on her record. The jury found Caswell guilty of all forty-three counts and sentenced her to eight years of probation, forty-three days in jail, and forty-seven days of in-home detention. An appeal followed and the holding was affirmed. Petitioner filed for certiorari and the Supreme Court of Colorado granted. Here, petitioner argues that the use of her prior convictions for animal cruelty to enhance her charges to felonies violates the Sixth Amendment and article II of the Colorado Constitution. The court first considered whether the legislature meant to make the statutory provision used to enhance Caswell’s sentence as an element versus a sentence enhancer. The court here listed five factors to consider whether a fact is an element or sentencing factor: (1) the statute's language and structure, (2) tradition, (3) the risk of unfairness, (4) the severity of the sentence, and (5) the statute's legislative history. Four of these five factors signaled a legislative intent to designate it a sentence enhancer, so the court concluded that the legislature intended to designate the fact of prior convictions as a sentence enhancer rather than an element. The court also concluded that the sentence did not violate the Sixth Amendment or article II of the Colorado Constitution, and affirmed the holding of the lower court.
Fund for Animals v. Kempthorne 538 F.3d 124 (C.A.2 (N.Y.),2008)

The Fund for Animals and others brought an action challenging public resource depredation order (PRDO) issued by the U.S. Fish and Wildlife Service concerning a species of migratory bird known as the double-crested cormorant. On appeal, the Second Circuit affirmed the grant of summary judgment, finding that the depredation order did not violate MBTA because the Order restricts the species, locations, and means by which takings could occur, thereby restricting the discretion exercised by third parties acting under the Order. Further, the depredation order did not conflict with international treaties (specifically the Mexico Convention) because the Treaty only mandates a close season only for game birds, which the parties agree do not include cormorants. Finally, the agency's adoption of the order was not arbitrary and capricious and complied with National Environmental Policy Act (NEPA).

Daughen v. Fox 539 A.2d 858 (Pa. Super. 1988)

Plaintiffs brought a claim for intentional infliction of emotional distress and loss of companionship after defendant animal hospital performed unnecessary surgery based on a mix-up of x-rays.  The court denied the first claim, finding the defendant's conduct did not meet the "extreme and outrageous" conduct test.  With regard to plaintiff's claim for loss of a unique chattel and for loss of the dog's companionship and comfort, the court observed that, under Pennsylvania law, a dog is personal property, and, under no circumstances under the law of Pennsylvania, may there be recovery for loss of companionship due to the death of an animal.  

Creekstone Farms Premium Beef, L.L.C. v. Department of Agriculture 539 F.3d 492 (D.C.Cir., 2008) Plaintiff, a supplier of beef products, brought an action against Defendant, the United States Department of Agriculture (USDA), after the USDA denied Plaintiff’s request to purchase Bovine Spongiform Encephalopathy (BSE) testing kits.   The United States Court of Appeals, District of Columbia Circuit found that the USDA has authority under the Virus Serum Toxin Act (VSTA) to regulate the use of biological products, the USDA’s interpretation of VSTA allowing the USDA to deny an import permit based on the product’s intended use was not inconsistent with the regulation and was therefore entitled to deference by the Court, the USDA’s interpretation of the word “treatment” as including diagnostic activities was entitled to deference, and that   BSE testing is a diagnostic activity for purposes of VSTA.
Thompson v. Hancock County 539 N.W.2d 181 (Iowa 1995)

In this case, the Supreme court of Iowa held that hog confinement buildings were agricultural buildings and thus exempt from county zoning ordinances.

Eastep v. Veterinary Medical Examining Bd. 539 P.2d 1144 (Or.App. 1975)

Petitioner-veterinarian sought judicial review of veterinary medical examining board's denial of his application for renewal of his license to practice, and the permanent revocation of his right to practice veterinary medicine in Oregon.  The Court held that there was ample evidence ample evidence to support board's finding that petitioner was guilty of unprofessional conduct for misrepresentation to dog owner of surgical services allegedly rendered, whether the standard adopted be that of 'clear and convincing evidence,' as petitioner urges, or that of 'reliable, probative and substantial evidence' (ORS 183.480(7)(d)), as urged by respondent.

State v. Smith 54 A.3d 638 (Conn.App.)

A defendant was charged and convicted of one count of permitting a dog to roam at large. Upon appeal, the defendant argued the statute he was convicted under was unconstitutionally vague and that he was convicted under insufficient evidence. Defendant contended that simply having his dog off-leash did not mean that it was roaming at large and not under his control where the dog responded to verbal commands. The court rejected both of defendant's arguments, finding that the plain language of the statute clearly prohibits an owner allowing a dog to move freely on another's property unrestrained and not under the owner's direct influence.

Christian v. Petco Animal Supplies Stores, Inc. 54 A.D.3d 707 (N.Y.A.D. 2 Dept., 2008)

This New York case consists of an action to recover damages for personal injuries. The plaintiffs appeal the granting of the motion of the defendant for summary judgment dismissing the complaint insofar as asserted against him and the cross motion of the defendants Petco. The infant plaintiff allegedly sustained personal injuries when she was bitten by a dog owned by the defendant Kenneth Coughlin at a Petco store. The court held that the evidence submitted established that the defendants were not aware that this dog had ever bitten anyone or exhibited any aggressive behavior.

IRVIN WILSON and PET PARADISE, INC. v. UNITED STATES DEPARTMENT OF AGRICULTURE 54 Agric. Dec. 111 (1995) Irvin Wilson, Sr. owns a corporation named Pet Paradise, Incorporated, which included a pet shop, also called Pet Paradise, specializing in exotic animals. The pet shop was operated by Irvin Wilson, Jr., who is now incarcerated on unrelated charges. Several inspections by the United States Department of Agriculture (USDA) resulted in a finding of 61 violations involving 27 of the regulations and standards promulgated pursuant to the Animal Welfare Act, 7 U.S.C. § 2131 et seq. The USDA imposed sanctions of a $5,000 fine and a suspension of the USDA license for 30 days or until compliance is shown. This court found no reason to disturb the sanctions imposed.
In re: PATRICK D. HOCTOR 54 Agric. Dec. 114 (1995)

Sanction in each case is to be determined by examining nature of violations in relation to remedial purposes of regulatory statute involved, along with all relevant circumstances, giving appropriate weight to recommendations of administrative officials having responsibility for achieving congressional purpose.

In re: OTTO BEROSINI. 54 Agric. Dec. 886 (1995) Congress has authority under Commerce Clause (Art I, § 8, cl 3) to give Department of Agriculture authority to regulate interstate activities within purview of Animal Welfare Act (7 USCS §§ 2131 et seq.), including activities of animal exhibitors.
In re: JULIAN J. TONEY AND ANITA L. TONEY 54 Agric. Dec. 923 (1995) Civil penalty of $200,000.00 (largest civil penalty ever imposed under Act) was appropriate, where degree of willfulness and flagrancy of respondents' violations was astonishing, and even after hearing was pending on initial complaint, respondents continued to violate Act.
Bronk v. Ineichen 54 F.3d 425 (7th Cir. 1995)

Plaintiffs appealed decision of district court denying their claim that defendants violated the Federal Fair Housing Act for failing to allow a hearing dog in their rental unit as a reasonable accommodation for their hearing disability. The landlord denied the request, alleging that the dog was not a "hearing dog," and that the tenants did not have a legitimate need for the dog because the dog lacked professional training. The Court of Appeals held that if the dog was not necessary as a hearing dog then the plaintiffs were not entitled to the dog as a reasonable accommodation under the FHA. Also, the court held that a disabled person must meet two standards in arguing that an accommodation be made: (1) the accommodation must facilitate the disabled person's ability to function; and (2) the accommodation must survive a cost-benefit balancing that takes both parties' needs into account. The court vacated the decision of the lower court and ordered a new trial because of misleading jury instructions. 

People v. Meadows 54 Misc. 3d 697, 46 N.Y.S.3d 843 (N.Y. City Ct. 2016), rev'd, No. 17-AP-002, 2017 WL 4367065 (N.Y. Co. Ct. Aug. 3, 2017)

Defendant Amber Meadows allegedly neglected to provide dogs Athena, Buddy, and Meeko, with air, food, and water, and confined them in a bedroom where feces was found on the floor and furniture. Meadows was prosecuted for three counts of the unclassified misdemeanor of failure to provide proper food and drink to an impounded animal in violation of § 356 of the Agriculture and Markets Law (AML). Meadows moved to dismiss the Information as facially insufficient and stated that the Supporting Deposition indicated that the dogs were “in good condition.” The People of the State of New York argued that the allegations in both the Information and Deposition, taken together, provide a sufficient basis to establish the elements of the crime. The Canandaigua City Court, Ontario County, held that: (1) “impounded” as stated in § 356 of the Agriculture and Markets Law does not apply to individual persons, and (2) even if the statute applied to individual persons, the allegations in the Information were not facially sufficient. The court reasoned § 356 does not apply to individual persons, but instead applies only to “pounds” operated by not-for-profit organizations, or kennels where animals are confined for hire. The court also stated that even if § 356 were to apply to individuals, under no construction of the facts here could the charge be sustained, as it appeared that the animals were properly cared for in the Defendant's apartment up to the point where she was forcibly detained. The conditions observed by law enforcement authorities on the date alleged in the Information were apparently several days after Meadow's incarceration and after which she was unsuccessful in securing assistance for the dogs while incarcerated. The Information was dismissed with prejudice, and the People's application for leave to file an amended or superseding Information was denied.

This Indiana case involves an action in replevin by John W. Akers against his former wife, Stella Sellers. The controversy at issue was ownership and possession of a Boston bull terrier dog. At the time of the divorce decree, the dog was not part of the property division and was instead left at the marriage domicile in custody of the former wife. Appellant-Akers claimed that legal title and the dog's best interests rested with him and unsuccessfully brought a suit in replevin in the lower court. On appeal, this Court held that there was no sufficient evidence to overturn the lower court's determination. The judgment was affirmed.
Criscuolo v. Grant County 540 F.Appx. 562 (9th Cir. 2013) The plaintiff’s dog was shot by a police officer while eyewitnesses claim that right before he fired, the dog was stationary or retreating at a distance of 10-20 feet from the officer and his police K9. The pet owner filed suit against both the individual police officer and the municipality, who both claimed immunity, which was granted at the trial court. On appeal, the court upheld the dismissal of the municipality based on the fact that official policy did “not authorize unconstitutional conduct or give officers unbridled discretion to shoot any animal they encounter, even if it is not threatening.” However, the appellate court reversed the trial court’s decision in regards to the officer’s immunity, holding that viewing the circumstances in the light most favorable to the plaintiff, the killing was not necessarily reasonable to protect the officer’s safety or the safety of his police K9.
McCall v. State 540 S.W.2d 717 (Tex. Crim. App. 1976).

Open fields doctrine; warrantless seizure. It was not unreasonable for humane society members to enter defendant's land and seize dogs where the dogs were kept in an open field clearly in view of neighbors and others, and where it was apparent that the dogs were emaciated and not properly cared for.

Reicksview Farms, L.L.C. v. Kiehne 541 F. Supp. 3d 935 (N.D. Iowa 2021) This case is brought by a farm in the business of raising and breeding pigs. Plaintiff brought suit against a veterinarian and veterinary clinic for several claims, including malpractice. Plaintiff alleges defendant failed to oversee and perform testing for Mhp, leading plaintiff to unknowingly transfer infected pigs to other farms resulting in monetary damages. Defendants moved for summary judgment and were denied, with the court holding that the two year statute of limitations for veterinary malpractice claims does not apply, and the five year statute of limitations for unwritten contract applies.
McGinnis v. State 541 S.W.2d 431 (Tex. Crim. App. 1976).

In an animal cruelty prosecution, the trial court should first instruct the jury on the definition of torture of an animal. Then, the court can permit the jury to determine whether the acts and circumstances of the case showed the torture of an animal.

Haviland v. Butz 543 F.2d 169 (D.C. Cir. 1976)

This case addresses whether the Secretary of Agriculture intended to include “animal acts” under the AWA. Animal acts are any performance of animals where such animals are trained to perform some behavior or action or are part of a show, performance, or exhibition. Defendant presented an animal act with dogs and ponies to paying audiences and occasionally appeared on commercial television. Defendant asserted that he did not “exhibit” animals simply by showing dogs and ponies and argued that the Secretary unconstitutionally added “animal acts” to the AWA. The court held that the inclusion of “animal acts” was authorized as“[t]he words ‘includes’ and ‘such as’ [in the AWA] point convincingly to the conclusion that the listing of types of exhibitions in the statutory text was intended to be but partial and illustrative.”

In Defense of Animals v. National Institutes of Health 543 F.Supp.2d 70 (D.C.C., 2008)

This FOIA case was brought against the National Institutes of Health ("NIH") by In Defense of Animals (“IDA”) seeking information related to approximately 260 chimpanzees located as the Alamogordo Primate Facility (“APF”) in New Mexico. Before the court now is NIH's Motion for Partial Reconsideration as to the release of records. This Court rejected NIH’s arguments that the records are not “agency records” because they belong to NIH's contractor, Charles River Laboratories, Inc. (“CRL”), a publicly held animal research company. Also, the Court was equally unconvinced that the information requested here is “essentially a blueprint of the APF facility,” and that release of such information presents a security risk to the facility.

Johnson v. City of Murray 544 Fed.Appx. 801 (C.A.10 (Utah),2013)

An animal control employee lost her job due to the city’s decision to outsource the department to another city. Plaintiff sued the city on eleven counts, but lost due to the district court’s grant of the city’s motion for summary judgment. On appeal, the plaintiff lost on her First Amendment, American Disability Act, Utah Protection of Public Employees Act, and breach of contract claims.

Farm Sanctuary v. United States Department of Agriculture 545 F. Supp. 3d 50 (W.D.N.Y. 2021) Plaintiffs (nonprofit organizations working to protect animals, people, and environments from industrial animal agriculture) filed suit against the USDA and FSIS challenging the implementation of the Modernization of Swine Slaughter Inspection rule, 84 Fed. Reg. 52,300 (Oct. 11, 2019) ("Slaughter Rule”). Plaintiffs contend that the rule allows nearly all pigs in the U.S. to be slaughtered as "unlimited speeds," thereby posing risks to animal welfare and consumer safety. Plaintiffs' lawsuit was later amended to add a claim that challenges Defendants' failure to ban the slaughter of non-ambulatory or "downed" pigs in the rule. Defendants filed motions to dismiss on the grounds that Plaintiffs have no standing to sue. Plaintiffs contend that they have been injured by Defendants' implementation of the Slaughter Rule. Specifically, Plaintiffs argue that the authorization of the high-speed slaughter rule directly conflicts with their organizational missions and redirects resources to counteracting the Slaughter Rule instead of other activities like rescue of animals and advocacy. Some of the plaintiff organizations further allege that their members include consumers who eat pork products and are concerned about the increased health risks they face from consuming products from pigs who have not been adequately inspected as well as impacts to the environment from increased slaughter. In addition, Plaintiffs allege that the FSIS is not consistent in its treatment of downed pigs versus downed cattle, and that downed pigs are inhumanely forced to rise/stand for slaughter resulting in potential exposure to the public of disease and other public health risks. The court first took up Defendants argument that Plaintiffs lack both organizational and associational standing. The Court has reviewed the amended complaint in light of this Second Circuit precedent and finds that Plaintiffs have plausibly alleged that they have been forced to divert resources from mission-critical activities to oppose the Slaughter Rule. In other words, Plaintiffs have plausibly alleged that Defendants’ unlawful practices have impaired and frustrated their ability to engage in mission-related activities and caused a consequent drain on their limited resources, which “constitutes far more than simply a setback to the organization's abstract social interests" sufficient to survive a motion to dismiss. Taking Plaintiffs allegations in their pleadings as true, the Court finds that the amended complaint contains allegations sufficient to support organizational standing. Having found that Plaintiffs have organization standing, the Court need not reach the issue of associational standing. Accordingly, Defendants’ motion to dismiss is denied. Finally, as to the 2020 Action concerning the downed pigs, the Court found that The Court reaches the same conclusion it did in the 2019 Action: that at this stage of the case, Plaintiffs have alleged organizational standing. The Court notes that several other Plaintiffs have submitted declarations from their members, which further explain how those organizations have sustained an injury-in-fact. Plaintiffs have plausibly alleged that they provide additional services beyond mere issue advocacy, that these services have been impaired by Defendants’ actions, and that they have been forced to shift their resources away from those services to oppose the slaughter of downed pigs. Defendants' motions to dismiss were denied.

U.S. v. Top Sky 547 F.2d 486 (9th Cir. 1976)

Defendant alleged that his treaty-based hunting rights incorporate a right to sell eagles.  The court disagreed, finding such an interpretation of those treaty rights contrary to Indian custom and religion.  Court also holds that defendant lacks standing to raise a religious challenge to the BGEPA based on the religious rights of others.  Court is likewise unpersuaded by defendant's overbreadth claim.  For further discussion on the abrogation of Indian treaty rights under the BGEPA, see Detailed Discussion of Eagle Act .

Viilo v. Eyre 547 F.3d 707 (C.A.7 (Wis.),2008)

Virginia Viilo sued the City of Milwaukee and two of its police officers under 42 U.S.C. § 1983 after an officer shot and killed her dog 'Bubba.' The district court denied the defendants' motion for summary judgment on the basis of qualified immunity and the defendants took an interlocutory appeal challenging this denial. The court found that defendants' interjection of factual disputes deprived the court of jurisdiction. The court further held that it is a violation of the Fourth Amendment for a police officer to shoot and kill a companion dog that poses no imminent danger while the dog’s owner is present and trying to assert custody over her pet.  

Friends of Animals v. United States Bureau of Land Management 548 F. Supp. 3d 39 (D.D.C. 2021) This case involves a motion for a preliminary injunction by the group Friends of Animals to prevent the Bureau of Land Management from gathering and removing excess horses inside and adjacent to the Onaqui Mountain Herd Management Area (“Onaqui Mountain HMA”) to reduce the number of horses to the low end of the appropriate management level (“AML”). The BLM contends such an accelerated removal is necessary because of the historic drought that has gripped the American West. The court first examined the language and legislative history of the Wild Free-Roaming Horses and Burros Act (WHA), noting that the overarching goal of the act is provide balance between the horses and ecological impact on the lands. The WLA requires the Secretary to strike this balance by setting appropriate management levels and deciding on how to deal with excess animals. In addition, the National Environmental Policy Act (NEPA) is also implicated with decisions to gather horses which is done primarily through the Environmental Assessment (EA) process. The court denied the motion for preliminary injunction finding the advocacy organizations were unlikely to succeed on merits.
Newell v. Baldridge 548 F.Supp. 39 (D.C. Wash. 1982)

Newell was a tropical fish importer who became involved in a mislabeling scheme to import endangered sea turtles.  On appeal, Newell claimed he lacked the requisite knowledge or intent because he did not directly handle the imported sea turtles, he could not have known that they were mislabeled.  The court held that substantial evidence in the record supports the findings below that Newell knew or should have known of the mislabeling of the shipments of sea turtles.  Further, the court upheld the imposition of $1,000 penalty for each violation of the Lacey Act because of the mulit-violation, mislabeling scheme and the vital public interest in deterring illegal wildlife trade.

Armstrong v. Riggi 549 P.2d 753 (Nev. 1976)

Joe Riggi delivered his two unregistered Pomeranian dogs to the Armstrongs' Poodle Parlor to be bathed and groomed. The dogs died while in the care of the bailee. Riggi commenced this action to recover damages alleging that the dogs were worth more than $10,000. The issue on appeal was whether the trial court incorrectly interpreted the state court rule regarding attorney fees. Since the appellate court did in fact determine error, the case was remanded.

Dec. 107 (1996) Only requirement of 7 USCS § 2149(a), which authorizes suspension or revocation of license of exhibitor if exhibitor has violated or is violating any provision of Animal Welfare Act (7 USCS §§ 2131 et seq.) or any regulation or standard promulgated by Secretary under Act, is that at least one of violations be willful; existence of additional violations not shown to be willful does nothing to take away Secretary's authority to suspend or revoke exhibitor's license.
In re: WILLIAM JOSEPH VERGIS 55 Agric. Dec. 148 (1996) Except as provided in 9 CFR § 2.11, neither Animal Welfare Act (7 USCS §§ 2131 et seq.) nor regulations issued under Act specifically provide for order prohibiting person who is unlicensed from obtaining license; nevertheless, Act provides that Secretary has general authority to promulgate such "orders," as well as such rules and regulations, as may be necessary to effectuate purposes of Act (7 USCS § 2151), which means that Secretary does have power to order that unlicensed person who violates Act, or regulations or standards under Act, be barred from licensure.
