| Lyman v. Lanser | --- N.E.3d ----, 2024 WL 970217 (Mass. App. Ct. Mar. 7, 2024) | This case is an appeal concerning an agreement to share possession of a dog between a couple that had ended their relationship. The lower court granted the plaintiff's motion for a preliminary injunction, the court of appeals vacated the order, then this appeal followed. The parties purchased the dog together while they were still a couple, and agreed to share the dog if they broke up. After the relationship eventually ended, the couple shared the dog on a two week alternating basis. Eventually, one party maintained custody of the dog and denied the other party access to the dog, so plaintiff filed this action for conversion and breach of contract, seeking specific performance of the custody agreement for the dog. The court here found that the dog is jointly owned property, the lack of a written contract does not bar the plaintiff from specific performance, and that the judge's order of specific performance was a suitable remedy since monetary damages would not allow plaintiff access to his shared property. Therefore, the court reversed the order vacating the preliminary injunction and denied the defendant's petition for relief from the preliminary injunction. |
| Animal Legal Def. Fund v. Olympic Game Farm, Inc. | --- F.Supp.3d ----, 2019 WL 2191876 (W.D. Wash. May 21, 2019) | This case has to do with the mistreatment and unsafe captivity of numerous animals kept at a roadside zoo in Sequim, Washington called Olympic Game Farm (OGF). The Animal Legal Defense Fund (ALDF) alleged that OGF’s failure to abide by the Federal Endangered Species Act, as well as alleged violations of Washington State animal cruelty laws created a public nuisance. OGF admitted one of the allegations, specifically, that they are not accredited but possess or display Roosevelt Elk. That was an admitted violation of Washington law which makes it unlawful for a non-accredited facility to possess such a species. That single admission supported ALDF’s public nuisance claim in addition to all of the other alleged state violations. The court stated that ALDF met the "low bar" of standing in a public nuisance context. Accordingly, OGF’s Motion to Dismiss was denied. |
| Danielson v. Cnty. of Humboldt | --- Cal.Rptr.3d ----, 2024 WL 3175240 (Cal. Ct. App. June 26, 2024) | Appellant Candis Danielson was seriously injured by dogs owned by Donald Mehrtens on his property. The injuries were so severe that she lost the lower half of her right leg and sustained damage to her other leg and hand. After Danielson was injured, Mehrtens surrendered both dogs to Humboldt County, which resulted in them being declared vicious and euthanized. Mehrtens was also barred from owning dogs for three years. She filed this action for damages against numerous parties, including Mehrtens and the County of Humboldt (Humboldt County or County). The County demurred. This appeal concerns solely the cause of action against the County for its alleged failure to perform a mandatory duty. This court first noted the record demonstrated Mehrtens had at least five different incidents over more than ten years that involved either an attack by his dogs or a report to animal control (including reports on biting, failure to license, and failure to vaccinate). When Dainelson was attacked by Mehrtens dogs in 2021, she argued that the County was liable for her injuries because it failed to perform mandatory duties imposed by the Humboldt County Code like impoundment and euthanasia of dogs that are unvaccinated, unlicensed, and dangerous. The County contended that there is no mandatory duty under the county code, to which the lower court agreed.This court found that the Government Claims Act provides immunity to public entities and employees for legislative action or discretionary law enforcement activity as opposed to mandatory duties. Here, the county ordinance did not impose a mandatory duty for the officer to petition for a hearing after one of Mehrtens' dogs had bitten a neighbor months earlier. In addition, the officer did not have a mandatory duty to impound the dogs due for licensing and rabies vaccination concerns. Finally, the dangerous dog ordinances also did not mandate seizing or impounding the dogs. Within the compulsory rabies vaccination code, the county did not impose a mandatory duty to impound unvaccinated dogs that had bitten someone. The use of the term "shall" in section 547-8 only applied after officer exercised his or her discretion in conducting an investigation. Similarly, the use of the term "shall" in two instances of the chapter on rabies vaccination did not create a mandatory duty because the decision of whether to impound a dog at all was discretionary. While the court "sympathize[d] with her desire to be compensated for her injuries," the failure to identify a law that created "a mandatory duty which was breached by the County" does not exist here. The lower court was affirmed. |
| Horton v. U.S. Dept. of Agriculture | 559 Fed.Appx. 527 (6th Cir. 2014) | Petitioner sold dogs and puppies without an Animal Welfare Act (“AWA”) dealer license. An Administrative Law Judge (“ALJ”) found the Petitioner violated the AWA and issued a cease and desist order to prevent further violations of the Act and ordered Petitioner to pay $14,430 in civil penalties. Both Petitioner and Respondent, the Administrator of the Animal and Plant Health Inspection Service (“APHIS”), appealed the ALJ's decision to a judicial officer (“JO”), acting for the Secretary of the Department of Agriculture, who increased the civil penalties amount from $14,430 to $191,200. Petitioner appealed this decision, alleging that (1) the ALJ and JO erred by failing to determine the willfulness of his actions, and (2) the JO improperly applied the Department's criteria for assessing civil penalties. The 6th Circuit found that since the AWA did not contain a willfulness requirement, the JO's failure to make a willfulness determination was not an abuse of discretion. Further, the 6th Circuit held that the JO's factual findings regarding Petitioner's dog sales were supported by substantial evidence. Lastly, the 6th Circuit held the size of the civil penalty assessed against Petitioner was warranted by law. The court denied the petition for review and affirmed the Secretary's Decision and Order. |
| The Gastronomic Cat Festival case, 2014 (Peru) | The Currunao Festival was an annual event held in southern Lima, Peru. This festival was a celebration dedicated to Santa Efigenia of Ethiopia. Traditionally, this festival included controversial practicesof consuming cats and subjecting them to races where fireworks were thrown at them. In 2013, a group of activists filed an Amparo lawsuit, seeking the immediate suspension of these practices, arguing these practices were cruel under Peru's former anti-cruelty law, No. 2725. Moreover, they stated that animals are sentient beings capable of experiencing pain and suffering. That same year, the Civil Judge in Cañete issued a temporary injunction, suspending these activities. In 2014, the Superior Court of Justice in Cañete permanently banned the practices, ruling that they violated the right to a balanced and healthy environment, fostered violence, and posed serious risks to public health and societal well-being. | |

| Sentencia C-045/19 | This Constitutional Court's decision declares sport hunting illegal in the entire territory. In its reasoning, the court stated that sport hunting is not an exception to the duty to protect animals against cruelty, as it does not satisfy any objective or purpose compatible with the Constitution. "It is not an expression of religious freedom, nor intended for food or medical or scientific experimentation. It is not done to control the species population and is not a deeply rooted cultural manifestation." The court further stated, "The sacrifice of an animal by humans is an extreme form of mistreatment as it eliminates its very existence and is an act of annihilation. When it is unjustified, an animal's death is cruel because it means understanding that the animal is exclusively a resource available to humans. Sport hunting, in short, is a harmful act insofar as it is aimed at capturing wild animals, either by killing, mutilating or catching them alive." "What happens here is an example of how the content and scope of constitutional norms adapt to a changing society. It is about the concept of a Living constitution, in which its scope and content take shape with the political community's economic, social, political, and cultural changes." | Rapa Ltd. v. Trafford Borough Council |
Section 2 of the Pet Animals Act 1951 states that a person shall be guilty of an offence if he "carries on a business of selling animals as pets in any part of a street or public place, [or] at a stall or barrow in a market". Small transparent cubes containing water and live fish were sold as novelty items, known as 'aquababies', from a barrow in a thoroughfare of a large indoor shopping mall. The Court found that this activity involved the carrying on of a business of selling pets in a "public place" and was therefore prohibited by section 2. |

| Rogers v. Teignbridge District Council |
A planned event called "The Creepy Crawly Show" was to have been held at a racecourse and to have involved the display and sale of small exotic animals by a number of different breeders, dealers and enthusiasts. The event's organizer applied to the local council for a pet shop licence under the Pet Animals Act 1951. The application was refused on the ground that the event was prohibited by section 2 of the Act which states that a person is guilty of an offence if he "carries on a business of selling animals as pets in any part of a street or public place, [or] at a stall or barrow in a market". The organizer's appeal to the local magistrates court was dismissed. Held: the holding of the event would have involved the carrying on a business of selling pets in a "public place". It would also have involved the selling of animals in a market. The event was therefore prohibited by section 2 and that it would have been unlawful for the local authority to have licensed it. |

| Sentencia Caso Humberto José Saldaña Taboada contra la Municipalidad Provincial de Trujillo - Peru | In this case, the plaintiff sued the mayor of Trujillo, Peru, to enforce an ordinance requiring the city to provide shelter for stray dogs. Trujillo lacked a municipal dog shelter and used the Anti-Rabies Center, which did not meet the legal requirements. The lower courts ruled against the plaintiff, interpreting the ordinance as applying only to potentially dangerous dogs. However, the Constitutional Tribunal found conflicting laws regarding the city's responsibilities and reversed the decision, ordering Trujillo to provide appropriate shelter or collaborate with nonprofits for housing the stray dogs. | |
